Terms of Use

These terms are the agreement between you and Athlync App Inc. (“Athlync”, “we”, “us”) covering the Athlync mobile app and the Athlync website at athlync.io (together, the “Service”). By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.

We are a British Columbia company. How we handle your personal information is set out separately in our Privacy Policy, which forms part of these terms.

What Athlync is

Athlync helps people find other players at their level, host and join games, run clubs and tournaments, and message each other about it. Athlync is a place to arrange sport. We do not organise, supervise, coach, referee or insure anything that happens when you actually turn up and play, and we do not own, operate or inspect the courts and facilities listed in the app.

Eligibility and your account

You must be at least 13 years old to hold an account. If you are under the age of majority where you live, you may use Athlync only with a parent or guardian’s involvement. Athlync is offered in Canada and the United States.

You are responsible for what happens under your account. Give us accurate registration details, keep your password to yourself, use one account rather than several, and do not let someone else use yours. Tell us at support@athlync.io if you think someone has got into it.

Your content

“Your content” means everything you put into Athlync: your profile and photo, games, clubs and tournaments you create, messages you send, ratings and comments you leave, and anything you write in a report.

Your content stays yours. You give us a non-exclusive, worldwide, royalty-free licence to store, copy, display and transmit it strictly so that we can operate Athlync — showing your profile to other players, delivering your messages to the people you sent them to, displaying your rating on a host’s profile. That licence exists to run the Service and nothing else: we do not sell your content, license it onward, or use it in advertising. It ends when you delete the content or your account, except where the Privacy Policy explains why something has to stay.

You are responsible for your content, and you confirm you have the right to post it. Do not post anything that is not yours to post.

Content and conduct that is not allowed

Athlync has no tolerance for objectionable content or for abusive behaviour towards other players. You agree not to post, send or do any of the following, anywhere in the Service, including in a direct message:

• Harassment, bullying, stalking, intimidation, or threats of violence against anyone.
• Hate speech or attacks on a person or group based on race, ethnicity, national origin, religion, disability, age, sex, gender identity or sexual orientation.
• Sexually explicit material, nudity, or any sexual content involving a minor.
• Content that is defamatory, deceptive, or impersonates another person, team, club or organisation.
• Content that promotes self-harm, illegal drugs, weapons, gambling, or any other illegal activity.
• Graphic violence, or content that exists to shock or disgust rather than to arrange sport.
• Spam, scams, phishing, chain messages, or unsolicited advertising and promotion.
• Sharing someone else’s personal information — their address, phone number, workplace or anything similar — without their permission.
• Creating fake games, clubs, tournaments or accounts, or leaving ratings that are not based on a game you actually played.
• Scraping, reverse engineering, overloading or attempting to gain unauthorised access to the Service, its data or its underlying systems, or using it to build a competing product.
• Using Athlync to arrange anything unlawful, or contacting another player after they have blocked you.

Reporting, blocking, and what we do about it

Anything on Athlync that somebody else wrote can be reported from inside the app: a person from their profile, a message from the conversation it sits in, and a game, a club or a tournament from the foot of its page. Tap the report control, pick a reason, and add anything you want us to know. You never have to tell the person you reported them, and we do not tell them either.

For anything a report control does not reach, or for something that takes more explaining than the form allows, write to support@athlync.io. A report by email is treated exactly the same way as one sent from the app.

You can also block another player, from their profile or from a conversation. Blocking stops them messaging you and stops you messaging them, and hides each of you from the other: you will not see their profile, games, clubs or tournaments, and neither of you can join events the other one hosts. It does not tell them it happened. Your blocked list lives under Profile → Blocked Users, and a block survives account deletion in both directions.

Two things blocking deliberately does not do. Your existing conversation stays visible to both of you, so you keep a record if you need to report them. And blocking does not remove either of you from clubs, games or tournaments you have both already joined — if someone is making you uncomfortable at an event, report them.

We review every report we receive and we act on it within 24 hours. Where a report is upheld we remove the content and, depending on what happened, warn the account, restrict what it can do, or eject the person from Athlync permanently. We can do any of that without notice where someone is at risk. We keep a record of reports and of what we decided — see the Privacy Policy for how long and why.

If something you see puts someone in immediate danger, contact your local emergency services first. Then tell us at support@athlync.io so we can act on the account.

We may also remove content, suspend an account, or refuse service where these terms are broken, where we are required to by law, or where leaving something up would put other players at risk. If we close your account for a reason other than a breach, we will tell you why.

Messages between players

Direct messages are private between the people in the conversation, and game and club chats are visible to everyone in that game or club, including people who join later and read back. Messages are not end-to-end encrypted: they are stored on our servers, and we can access them where we need to in order to investigate a report, comply with the law, or keep someone safe. Do not use Athlync to send anything you would not want reviewed under those circumstances.

Games, ratings, and meeting people in person

Athlync introduces you to people you may not know and to places you may not have been. You decide who to play with and where, and you do that at your own risk.

Sport carries a risk of injury. By using Athlync to arrange or join a game you accept that risk, and you agree that Athlync is not responsible for injury, loss, damage or theft arising out of a game, a venue, or the conduct of anyone you meet through the Service. We do not run background checks on players, we do not verify that anyone is who they say they are, and a skill level in a profile is that player’s own claim, not something we have tested. Bring your own judgement: meet in public, tell someone where you are going, and leave a situation that feels wrong.

Ratings and comments about a host are the opinion of the player who left them. Leave ratings honestly and only for games you played. We remove ratings that break the rules above, but we do not otherwise arbitrate whether a rating was deserved.

Any fees, bookings or arrangements for a court or facility are between you and whoever runs it. Athlync is not a party to that, does not take payment for it, and cannot guarantee that a listed court is open, available or in the condition described.

Our intellectual property

The Athlync name, logo, app and website — their design, text, graphics and software — belong to Athlync App Inc. or its licensors. Using the Service does not transfer any of that to you. We grant you a personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these terms.

Third-party services

The Service depends on services other companies run — among them Railway, Cloudflare, Google Firebase, Sentry, Apple, Google Maps and Apple Maps, and, if you use Google sign-in, Google. They are governed by their own terms, and we are not responsible for them. The Privacy Policy sets out what each one handles.

Ending it

You can delete your account at any time: Profile → Settings → Delete account, or email privacy@athlync.io and we will do it. The Privacy Policy sets out exactly what is removed and what stays.

We may suspend or close an account that breaches these terms, and we may stop offering the Service, or part of it, with reasonable notice where we can give it.

The app is provided as is

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that games or players shown will be suitable, or that anything a player tells you is true.

Limitation of liability

To the fullest extent permitted by law, Athlync App Inc. will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to CAD $100.

Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by our negligence. Some jurisdictions do not allow certain limitations, in which case the limitations above apply only as far as that jurisdiction permits.

Indemnity

You agree to indemnify Athlync App Inc. against claims, losses and reasonable legal costs arising out of content you posted, your use of the Service, or your breach of these terms.

If you installed Athlync from the App Store

These terms are between you and Athlync App Inc. only, not with Apple, and Apple is not responsible for the app or its content. The licence granted above is limited to using Athlync on Apple-branded products you own or control, as permitted by the Usage Rules in Apple’s App Store Terms of Service.

• Apple has no obligation to provide maintenance or support for the app. Support requests go to support@athlync.io.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation whatsoever, and any remaining claim is ours to answer.
• We, not Apple, are responsible for any claim about the app — product liability, a failure to meet a legal or regulatory requirement, a consumer protection claim, or a privacy claim.
• We, not Apple, are responsible for investigating and resolving any claim that the app infringes someone’s intellectual property.
• You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the Province of British Columbia and the laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of British Columbia have jurisdiction, and nothing here takes away consumer protection rights you have where you live.

Changes

We may update these terms. The date at the top shows when they last changed. Where a change matters we will tell you in the app or by email before it takes effect; continuing to use Athlync after that means you accept the updated terms.
